project comprises the development of a small satellite gas field by means of a subsea production system
The responsibilities of the incumbent in respect of the various contracts which will be required are as follows:
Prior to award: preparation of prequalification and tender documents (as appropriate), receipt and clarification of tenders, negotiation, award and preparation of formal contracts.
After award: provision of contractual/commercial advice and support, administration of contracts for works/goods/services in such a manner as to ensure the Project’s best commercial interests are both served and protected and the monitoring of relevant markets and contractor performance.
Furthermore, when the workload permits, the incumbent will be expected to give advice and support from time to time to the Laggan Tormore team
The incumbent will

Conduct contracting business in compliance with company Contracts & Procurement guidelines and procedures.
Promote the Contracts function as a managed process which requires timely input from technical departments.
Act as highly visible communications focal point with specialist/dedicated client group(s), operating as a ‘Duet’ with technical counterpart(s), to proactively facilitate effective relationships, contract planning & management.
Be open to receive contractor/supplier representatives.
Proactively build and maintain relationships with contractors/suppliers in order to secure positive, constructive and cost effective commercial agreements for the Project.
Establish contracting strategy with ‘Duet’ counterpart to serve & protect Project’s best commercial interest.
Review and consider legal aspects associated with contract award & administration, liaising with the Senior Legal Adviser, providing advice to clients as appropriate & assisting as appropriate in settlement of law suits.
Review and consider insurance and indemnity aspects, liaising with the Insurance Adviser.
Collaborate with the Technician in the development of lists of tenderers.
Compile issue and administer ‘Invitation to Tender’ packages to procure the most realistic and commercially attractive proposals from potential contractors/suppliers. (This includes providing commercially relevant advice and, after reviewing input received from Technician, integrating it into the ITT).
Draft appropriate contractual and commercial terms & conditions, using existing model contracts where applicable, to best serve & protect Project’s interests.
Prepare tender evaluation plans, review tenders, participate in clarifications, conduct negotiations and administer the award of contracts & contract amendments.
Debrief unsuccessful prequalifiers and tenderers, if requested.
Ensure all contracting activities meet audit requirements in compliance with Company guidelines, policies and procedures and UK/EU legislation in order to minimise any potential audit exceptions, partner claims or court actions.
Provide general assistance & advice on contractual & procurement matters as required to support Project’s operations (including particularly advising on interpretation of contractual provisions, claims & correspondence).
Review standard contract documentation & procedures and identify, promote & implement improvements, liaising with other interested parties as appropriate.
Represent Project’s Contracts Function in meetings with suppliers/contractors.
Prepare and validate all contractual correspondence.
Prepare and ensure that a close monitoring of all reimbursable activities under the contract (i.e. all SITE Activities) is put in place so as to minimize Company’s exposure to undue claims.
Administer any necessary post-award contract changes (scope, growth, contractual, commercial) through the use of a structured and auditable Change Order system.
Ensure post-award contract documentation ( Performance and Parent Company Bonds, insurance policies, Bank Guarantees etc) are submitted on time and in the correct format to Company.
Assist the Company Contract Representative in the timely issue of interim and final certification, application of any notification window mechanism and adoption of any chosen options.
Based in Aberdeen
Travel to other project locations may be required as part of the post
Qualifications/ Experience required
Typically degree qualified in Quantity Surveying, Law, Engineering or relevant business area, ideally with a post-graduate qualification in a complementary area and a chartership with a professional body, such as being a Member of the Royal Institution of Chartered Surveyors (“MRICS”), and/or “Member of the Chartered Institute of Purchasing and Supply (“MCIPS”)
Knowledge & understanding of procurement processes including: ethical principles; tenderer prequalification; invitation to tender; comparative evaluation of contractors; award, management, amendment & close out of contracts
Typically 10 years, practical, relevant and progressive professional experience in preparation and negotiation of complex technical contracts
Typically 5 years (or more) experience in the offshore oil or petrochemical industries
Demonstrable general knowledge & understanding of the technologies utilised by oil and gas operators
Demonstrable general knowledge & understanding of commercial, legal and insurance issues affecting the Company in general, & “in depth” understanding where relevant to contracts for works, goods & services
Extensive & detailed knowledge & understanding of use of model contract conditions with particular emphasis on the liability, indemnity & insurances regime applied by Companies in the UK, & the ability to identify & assess relevant risks & modify and/or supplement standard provisions as appropriate
In depth knowledge & understanding of different means of contractor remuneration & their commercial implications, practical experience of their use, & sound ability to select & draft appropriate provisions
Basic understanding of the technical domain in which the Project’s clients operate
Ability & willingness to facilitate/chair any meetings required to conduct the activities of the job
